Covid-19 Waiver

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. Dynamic Body Pilates LLC (“DBP”) has put in place preventative measures to reduce the spread of COVID-19 at 80 Fifth Avenue, Suite 1003, New York, New York 10011 (“Studio”); however, DBP cannot guarantee that clients, contractors, employees, or others will not become infected with COVID-19.

READ CAREFULLY BEFORE SIGNING

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities recommend practicing “social distancing” and I agree to make every effort to keep at least 6 ft between myself and any other individual while in the Studio.

I acknowledge that DBP requires face masks in the Studio and masks must be worn covering both nose and mouth at all times. Bandanas, gaiters, or handkerchiefs do not qualify for acceptable face coverings in the Studio.

I acknowledge that DBP has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.

I further acknowledge that DBP can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, contractors, employees, and other clients and their families.

I voluntarily seek services provided by DBP and acknowledge that I am increasing my risk of exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my session.

CHECK BOX FOR EACH PARAGRAPH BEFORE SIGNING

I hereby release and agree to hold Dynamic Body Pilates LLC, all owners, contractors, and employees harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the studio, or that may otherwise arise in any way in connection with any services received from Dynamic Body Pilates LLC. I understand that this release discharges Dynamic Body Pilates LLC from any liability or claim that I, my heirs, or any personal representatives may have against Dynamic Body Pilates LLC with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Dynamic Body Pilates LLC.

If I have signed a separate general waiver of liability connected to my participation at Dynamic Body Pilates LLC, I agree that the terms of that waiver are wholly incorporated into this document and that the terms of this document are incorporated into the separate general waiver.

Duty to Self-Monitor: I agree to self-monitor for signs and symptoms of COVID-19 and contact DBP immediately at [email protected] if I experience symptoms of COVID-19 within 14 days after a session at DBP.

Automatic Termination: I understand if I fail to abide by the policies and procedures promulgated by DBP in reopening its Studio in compliance with state and city government standards of social distancing, safety, and sanitation, Dynamic Body Pilates LLC reserves the right to rescind my access to in-studio Pilates sessions. Remaining sessions on any series or membership will be available for virtual sessions. I understand no refunds, discounts, or promotions will be given.
